1. Scope of Service

The services provided consist of custom data extraction, transformation, and structuring from publicly available datasets, including but not limited to CERN Open Data, CMS Open Data, and NanoAOD ROOT files. The deliverables may include CSV, Parquet, ROOT, or other flat or semi-flat data formats, as explicitly agreed with the Client prior to execution.

2. No Affiliation Disclaimer

The Provider is not affiliated with, endorsed by, or acting on behalf of CERN, the CMS Collaboration, or any other LHC experiment or institution. All services are performed independently and exclusively on publicly accessible data or data lawfully provided by the Client.

3. Nature of Deliverables

All delivered datasets, scripts, and files are provided “as is”, without any express or implied warranty. The Provider does not guarantee:

• scientific correctness or interpretability of the data,
• suitability for any specific analysis, publication, or result,
• absence of errors originating from upstream datasets or reconstruction pipelines.

4. Client Responsibility

The Client is solely responsible for:

• verifying the integrity, completeness, and correctness of the delivered data,
• validating all results prior to analysis, publication, or submission,
• ensuring compliance with institutional, funding, and collaboration policies.

By paying, Client confirms they have read and accepted that the Client understands the technical nature and limitations of data extraction services.

5. Payments & Refund Policy

All payments are final. No refunds are provided once data extraction or processing has started, regardless of downstream usability, analysis outcome, or changes in research direction. The Client is encouraged to request a trial sample (if offered) prior to full execution.

6. Limitation of Liability

To the maximum extent permitted by law, the Provider shall not be liable for:

• scientific errors, null results, or failed hypotheses,
• missed deadlines, rejected publications, or grant-related consequences,
• indirect, incidental, or consequential damages of any kind.

The total liability of the Provider, if any, shall not exceed the amount paid for the specific service.

7. Intellectual Property & Attribution

The Provider:

• does not claim authorship or co-authorship of any scientific work,
• does not require citation, acknowledgment, or attribution,
• waives any claim to intellectual contribution beyond technical data handling.

All scientific interpretation, conclusions, and publications remain the sole responsibility of the Client.

8. Confidentiality & NDA

Any non-public information provided by the Client is treated as confidential. The Provider agrees to:

• not disclose project-specific information to third parties,
• not use project data for portfolio, marketing, or case studies,
• not retain working data longer than 30 calendar days after delivery, unless otherwise agreed.

This clause functions as a lightweight mutual NDA unless a separate agreement is executed.

9. Data Retention & Deletion

Intermediate files, logs, and datasets are deleted within 30 days after delivery. The Client is responsible for maintaining backups of delivered data.

10. Governing Law

These Terms shall be governed and interpreted under the laws of the Provider’s country of registration (Ukraine), without regard to conflict of law principles.

11. Acceptance of Terms

By ordering services, submitting payment, or using delivered materials, the Client confirms acceptance of these Terms of Service in full.
